INFORMATION CLAUSE
Pursuant to Article 13(1) and (2) and Article 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter “GDPR”, we inform you that:

Purposes of processing and legal basis
We process your personal data for:
1) the conclusion and execution of contracts and orders for customers or contractors, the processing of trade credit applications, possible complaints, etc,
2) compliance with legal obligations incumbent on the controller,
3) conducting business, business contacts and correspondence,
4) to establish, pursue or defend against claims.
The legal basis for the processing of your data is Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU. L. 2016 No. 119, p. 1) – hereinafter GDPR, (i.e. processing is necessary for the performance of a contract to which you are a party or to take action at your request prior to entering into a contract), Article 6(1)(c) of the GDPR (i.e. processing is necessary for the fulfilment of a legal obligation incumbent on FAM S.A. such as, for example, an archiving obligation) and Article 9(2)(f) of the GDPR (i.e. processing is necessary to establish, assert or defend claims).
Recipients of personal data
Recipients of your personal data will be those entities to which we are obliged to transfer your data under applicable laws, as well as entities providing FAM S.A. with debt collection services, legal services and courier and postal services.
Transfer of data to third countries
Your personal data is not transferred to third countries or international organizations.
Data retention period
Your personal data will be stored for the period of cooperation with the entity and after its termination – until the expiry of the storage period indicated in the applicable legislation and the statute of limitations for any claims.
Your rights
You have the right to access your personal data, to correct it, to request its deletion or to object because of your particular situation. You also have the right to request FAM S.A. to restrict the processing of your data, as well as to have your data transferred in the event that the two prerequisites under Article 20 of the GDPR are fulfilled.
Complaint to the supervisory authority
You have the right to lodge a complaint with the President of the Data Protection Authority if you consider that the processing of your personal data violates the provisions of the GDPR.
Obligation to provide data
The provision of data is voluntary, however, it is necessary for the establishment of cooperation and the realisation of contracts as well as for ensuring business contacts, and their nonfeasance will prevent the establishment of cooperation and the realization of orders.
Automated decision-making
Your data will not be used for automated decision-making (including profiling).
